NO MERCY! Blantyre Magistrate Court Thursday sentenced gay lovebirds Tiwonge Chimbalanga, 20, and Steven Monjeza,26, to the maximum 14 years in prison with hard labour after being convicted of buggery, unnatural acts and gross indecency.
” I sentence you to 14 years with hard labour each. This is the maximum sentence under the Penal Code…Maximum sentences are intended for use for worst cases,” Resident Magistrate Nyakwawa Usiwa Usiwa said as he delivered his sentence in a jam-packed court.
Tiwonge Chimbalanga & Steven Monjeza
He added: “We are sitting here to represent the Malawi society which I do not believe is not ready at this point in time to see its sons getting married to other sons or conducting engagement ceremonies. I dont believe Malawi is ready to smile seeing its daughters marry each other.”
He explained that the case was the “first and worst” of its kind in the country, and he meted a “scaring sentence” so that the public should be protected from the convicts so as not to emulate the horrendous example.
Usiwausiwa also said he had arrived at the sentence based on previous cases of sodomy.
“This case carries a sense of shock against the morals of Malawi,” Usiwa Usiwa added.
Dressed in blue jean top and a pair of trousers Tiwonge known as ‘Aunt Tiwo’ looked composed as usual compared to Steven who was wearing on a black jacket and a white shirt with a blue, white and grey stripped tie who looked dejected.
The magistrate said the convicts were free to appeal their sentence to the High Court.
In an interview soon after the sentencing, defense lawyer Mauya Msuku said there was nothing to comment. He said the court was free to sentence his clients from a minimum of zero to a maximum of 14 years.
“In this case the court has opted for the maximum sentence and the law allows that,” Msuku said.
Asked whether he will appeal or not, Msuku said it was not up to him to comment but that it was up to Tiwonge and Steve to appeal if they wished.
State prosecutor Barbra Mchenga refused to comment but referred this reporter to the Southern Region Police publicist Davie Chingwalu.
When contacted Chingwalu said the police are happy and satisfied with the sentence.
“Our role as police is to enforce the existing laws of our country and this includes the law on homosexuality… We will not stop enforcing it,” he said.
The case, which started following the arrest of the two on Decemeber 26 after they had an open engagement ceremony in Blantyre, has attracted local and international interest.
Some donors have warned the government to tread carefully on the issue of minority rights.
Despite such concerns government has stood its ground that as a sovereign state it has its own laws.
President Bingu wa Mutharika condemn homosexuality saying “the practice is evil and very bad before the eyes of God. It is against moral and our cultural values.”
Malawi is not alone in dealing with the controversy surrounding homosexuality, as the same in taking place in many other countries.
Homosexuality is outlawed in at least 37 countries in Africa. Currently Ugandan lawmakers are considering a bill under which homosexuals could be sentenced to life imprisonment.
South Africa is the only African country that recognizes gay rights but even there have been incidents of gangs raping lesbians.
As in the Guyana and Caribbean experience, there is a danger that “human rights” groups and some donors will now threaten Malawi based on grounds that cannot withstand careful scrutiny.

We had previously sought to show that the African legal and social position on homosexuality and gay rights was not arbitrary or whimsical, but in fact buttressed by a tonnage of scientific and medical research … which frequently escapes the eyes and ears of gay rights activists. Why are these facts ignored by “human rights” groups?
Why does the medical/psychiatric profession, or Western donor nations, not STILL consider that homosexuality is a problem? Some of the issues are addressed by Dr. Joseph Nicolosi in the article “The Removal of Homosexuality from the Psychiatric Manual” ( http://www.catholicsocialscientists.org/CSSR/Archival/2001/Nicolosi_71-78.pdf ).
Gay militancy, we will find, is fuelled as much by the unwillingness of the population to read, as it is by an astonishingly bold effort at deception and trickery by its supporters. In this case, obviously, they completely misjudged the will of the Malawi legal system.

Around the world, educated men and women know that there have been thousands of prominent gay men and women, including Alexander the Great, Michelangelo, Shakespeare, and countless others, including many in the Arabic world. Likewise, numerous professional psychological associations have recognized that homosexuality is no longer considered a sexual deviancy.
What is sad is that people who profess to be “Christian”, “moral”, and “compassionate”, would strive to abuse, beat, torture, and violate the rights of gay men and lesbian women.
Africans need to examine their religious beliefs and ask themselves why they would participate and uphold a religion which promotes these abuses of our fellow citizens.

Every single item on his blog is a copy of some report or some complaint, or some news article in some country wherein some government is promoting hatred and the abuse of gay people. Mr. Williams never actually writes a real blog, providing any information or his own views, all he does is copy extracts from newspapers etc., and then makes those his blog, pasting a copy of the original letter, blog, etc.
Interestingly enough, real scientific studies show, (real scientific studies) that men who are so concentrated and fixated on this kind of hatred against gays are usually gay themselves!

Another good read is about coming out. It is for understanding the issues surrounding admitting to oneself and others that one is gay. It is also helpful for those who do not understand the lives of gay men and women, and is written by psychologists.

I want to return to the links Mr. Williams provides. Again, these are from his blog, and as such are not scientific. The many articles he shows do not show “a tonnage of scientific and medical research…” as he claims. The fact is that there is no such research. The links that he provides are simply blogs, written by homophobic writers.
Anyone can have a blog and write anything they want. Providing a link to a site doesn’t mean that it is written by a professional. One can write about Zeus descending down from the heavens, or having a drink with martians in a local bar, but most people, with the ability to think for themselves, will not readily accept such claims. There are, however, many blogs written by anti-gay individuals, many of them evangelical Christians and other religious organizations that specifically want to thwart the rights and even the existence of gay men and women.
One of the links Mr. Williams provides us points to the writing of someone from the Catholic church. Whatever your religious views are, it is clear to millions that the Pope is not the brightest guy on the planet. When he told Africans that using condoms could actual help spread HIV, he lost his credibility both as a religious leader, and as a spokesperson for the Catholic church.
Many do not know that the Catholic church and the Vatican, in the 1940s, specifically ordered its priests in German churches to preach against the rights and lives of Jewish men and women! This went on for years before Hitler even took power. The Catholic church is a church which has lost millions of its followers and now has embarked on an anti-gay bandwagon, and has enlisted the help of the people of various African countries to help them promote their hatred. Seeking to increase its membership, the Catholic church and the pope has decided that it will enlist members by launching a war against gay men and women. Sadly, many Africans do not see what the Church is doing and how this will affect the lives of African men and women.
The reason the Catholic church and many other Evangelical churches in the US are using Africans in their quest is because they know that the majority of Africans do not have access to world news, to computers, to the internet, etc, and that they are able to spread their hatred in countries like Uganda and Malawi quite easily. It is not that Africans are any less intelligent than other world citizens, but it is true that for many reasons, Africans do not have access to information and as such they are not aware of the different issues being discussed in the world. It is this lack of access to information that the Chinese and other countries have used against their people, and it is what the Catholic church and Evangelical churches are doing also.
Evangelical churches have spread in the African communities like a germ, infecting many, including Christians and Muslims, promoting their hateful message. Behind this growth and hatred are countless American Evangelical ministries, helping to promote this monstrous growth.
The fact is that many countries have opened their doors to gay men and women, and in many countries people are granted the very same rights that heterosexual men and women are granted. Even in the US, which had prohibited gay men and women from openly serving in the military, have now changed their positions. It is only because the Christian right is no longer in control of the White House that these changes have occurred.
However, many other countries, including the country I live in, Canada, have allowed gay men and women to serve openly for the past decade—with no problems!
Furthermore, there is no scientific evidence whatsoever that gay men commit more crimes against children than heterosexual.
In fact, the opposite is true: it is heterosexual men who are, by far, committing crimes against children.
Even though this is a fact, we do not, in civilized countries, create laws to execute men or women who abuse children. We do have rehabilitation programs, or if the incidents are consistent, there are courts and prisons to facilitate the treatment of these individuals.
The hatred that Mr Williams professes is another sad attempt to paint gay men and women as monsters, but the fact is that there are many gay men and women who have been working with children for years and have never abused children.
Anyone with the ability to use the internet, and has an open mind to discover the truth, will be able to find real scientific studies and psychological periodicals which show that gay men and lesbian women are not, as the writer says, guilty of assaulting children. The writer is either ignorant of the facts, or he is trying to badmouth gay men and women. Given the number of pages he posts on his website, and the fact that he doesn’t speak about anything else, it is clear that Mr. Williams has as his goal, the disfigurement of the gay community.
I would also encourage others who are interested in reading more to read Wikipedia, which is written and maintained by educated, and intelligent individuals.

The site also shows that the National Institute of Mental Health, the American Psychiatric Association, the National Association of Social Workers, and hundreds of other organizations around the world, have clearly noted that extensive studies carried out by scientists, show that gay men and women are no different than other men and women.
I also noted that in 2001, the Chinese Society of Psychiatry, after ordering a five-year study, demanded that homosexuality be removed from the Chinese Classification of Mental Disorders. Many other countries have created similar scientific studies to show that gay men and women are just the same as the rest of us. Even China, which is rather backwards when it comes to human rights, took a giant step in ordering a professional study and realized that gay men and women are not deviants, and that they do not suffer from some strange disorder.
Likewise, the World Health Organization’s ICD-9, which had listed homosexuality as a disorder, removed it at the Forty-third World Health Assembly, in 1990. This is one of the largest organizations in the world.
I would hope that readers would consider this: During the 1940s, the Nazis took control of Germany. They incited violence and hatred against gay men and women, the Jehovah’s Witnesses, and Jews. At every opportunity, Germans brain washed the country into believing that they were a superhuman race and that gays, Jews, and other groups, like gypsies and the Jehovah’s Witnesses, were subhuman. They built huge gas chambers and camps and tortured, raped, and brutalized men, women, and yes, children.
What would you have done if you had been living in Germany? Would you have seen the errors? Would you have objected when the Catholic Priest in your neighborhood told you that the Jews were nothing but a dirty horde or rats, and that they were not human, and deserved to be beaten, even killed? What would you have done? I know that I would have rejected all the ideas of the Nazis because even though I am not a Christian, i know that human life is precious, and that each and every one of us is worthy of respect, dignity, and equality. I don’t know if I could have lived in Germany, but surely I would have joined the resistance, or I would have fled, trying to save as many Jews, gay people, as possible.
So today, what do you do? Do you listen to every single word of your preacher, or of the politicians?
I hope that readers in Malawi, and in other African countries will carefully examine the behaviour of their church leaders, their priests, their Imams. I hope that they will realize and recognize that men and women are equal, and that gay men and women, even though you may not understand them, deserve to be treated with dignity and respect.

The psychiatric profession had never before seen forged credentials, physical intimidation, and brutal rhetoric used at a scholarly meeting.
The object of the homosexuals¶ fury was, of course, a long-held tenet of the psychiatric profession: homosexuality, based on a wealth of evidence, is a pathological condition, not a normal outlet of sexual expression. Homosexuality had long been listed in the Diagnostic and Statistical Manual, Mental Disorders (DSM-1). It was, therefore, a ³mental disorder.´As Dr. Karl Menninger had written several years earlier, ³Whatever it be called by the public, there is no question in the minds of psychiatrists regarding the abnormality of such behaviour.´ It would have been difficult for Beiber to believe that such brutal, unsophisticated, and unscholarly assaults could change the results of scholarly research. But the homosexual objective was clear. They wanted homosexuality deleted from DSM-II.
And shockingly, as a ³craven capitulation to the power of the mob,´ the APA decided to delete homosexuality from its list of mental disorders. Many dissenters were outraged. The profession had ³disgraced itself.´ Another observer said, ³it now seems that if groups of people march and raise enough hell, they can change anything in time « will schizophrenia be next? And one psychiatrist wrote: ³The Board of trustees [of the APA] has made a terrible, almost unforgivable decision which will adversely affect the lives of young homosexuals who are desperately seeking direction and cure.That decision « will give [them] an easy way out.´

Indeed, Dr Satinover makes reference at Chapter 12 in his book to no less that 15 secular institutions in the USA that have reported success in as high as 82% of cases in the treatment and therapy of same-sex-attraction-disorders!

I forgot to mention the most important point.
Paul Cameron, who is responsible for the studies and the debate and the work which claimed that homosexual molest children more than heterosexuals do, was suspended and lost his membership with several important professional associations.
Memberships from these organizations and the year they were pulled: The American Psychological Association (1984), The Nebraska Psychological Association (1984), the American Sociological Association (ASA) (1986), the Canadian Psychological Association (1996).
One wonders what one would do when one loses face, especially in the USA, so
Cameron also served as Chairman of Family Research Institute, the right wing Christian evangelical, anti-gay group. This is one of many groups that was formed to create laws denying gay men and women the right to marry, etc. Fortunately, Americans are beginning to see that denying gay men and women the rights granted other Americans is tantamount to pure discrimination.
As such, the work of Paul Cameron has been discredited and members of all these organizations have been notified that the work of Cameron is not valid. Not only did they distance themselves and pull his membership, but they did so for violating rules.
The real Cameron then went to work at Moscow University. This is a place where a man like Cameron can hide out.
For the real story on Cameron, and others like him, so he took his misguided thoughts and worked at the Family Research Institute. In 2008 he was working at the University of Moscow, again preaching his anti-gay rhetoric, claiming that homosexuals would invade the world.
Unfortunately for the students of Moscow University, they are being taught by a man who has no credentials in the west. He is busy teaching and making claims that other scientists have regarded as junk science, having done the same exact research as Cameron, who is again lying about his results to show that gay men and lesbian women drink more than heterosexuals, and other ridiculous notions. The fact is that he is also publishing his “research” in reviews where authors have to pay to have their work published. In the west, we call these Vanity Presses, and anyone can publish a book of poems, regardless of the quality of the writing. This is the same kind of “scientific review”.

Gay militancy, we will find, DEPENDS on the fact that the heterosexual population would rather NOT read about the “deathstyle” .. and usually hope that a clever combination of rhetoric and abuse will further disenchant the everage reader!

Yet, they denounce as unethical any healthcare professionals who offer therapy to homosexuals who wish to become heterosexuals.
In other words, it is ethical to counsel a man to have his penis removed so he can have sex as a heterosexual woman, but it¶s unethical to counsel a man to have sex as a heterosexual man even if he wants to have sex as a typical man….”
